HOMEMART TERMS OF SERVICE

Welcome to HOMEMART. The terms “we,” “us,” and “our” refer to HOMEMART LLC. HOMEMART operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). HOMEMART is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced herein (collectively, the “Terms”), describe your rights and responsibilities when you use the Services.

When you place an order, you are making an offer to purchase products from HOMEMART. We reserve the right to accept, reject, limit, or cancel an order where permitted by applicable law.
An order is not considered finally accepted until HOMEMART confirms the order and any required payment has been successfully processed or an authorized payment arrangement has been established.

If we need to modify, reject, or cancel an order, we may attempt to contact you using the email address, telephone number, or other contact information provided with the order.
Returns, exchanges, refunds, and cancellations are governed by our Return & Refund Policy.
Unless otherwise expressly agreed by HOMEMART, purchases made through our consumer online store are intended for personal or household use and not for unauthorized commercial resale or export.

When using a payment method, you represent that you are authorized to use that payment method and that the information you provide is accurate.
You agree to pay all amounts associated with your accepted order, including applicable taxes and any other charges clearly disclosed before purchase.
SECTION 5 - LOCAL PICKUP
HOMEMART currently offers local pickup only unless another fulfillment method is expressly offered for a specific order.
Orders must be picked up at the designated HOMEMART pickup location. Pickup may require an appointment and confirmation from HOMEMART.
Please do not arrive for pickup until you have received confirmation that your order is ready for pickup.
Customers are responsible for arranging appropriate transportation for their merchandise after pickup, including a vehicle of suitable size and any equipment or assistance necessary to safely transport the merchandise.
Customers are encouraged to inspect merchandise at the time of pickup and notify HOMEMART of any visible damage, missing parts, incorrect merchandise, or other apparent issues before leaving the pickup location whenever reasonably possible.
Once merchandise has been picked up, the customer is responsible for safely transporting, handling, assembling, storing, and using the merchandise.
Damage occurring after pickup as a result of transportation, improper handling, improper assembly, misuse, modification, accident, or normal wear and tear is not considered a product defect.
Returns, exchanges, damaged or defective merchandise, and refunds are governed by our Return & Refund Policy.
SECTION 6 - INTELLECTUAL PROPERTY
The Services, including trademarks, branding, text, graphics, images, photographs, videos, audio, designs, layouts, and other content owned or licensed by HOMEMART, are protected by applicable intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial purposes.
Except as permitted by law or with prior written authorization, you may not reproduce, distribute, modify, republish, display, transmit, sell, exploit, or create derivative works from protected HOMEMART content.

HOMEMART is powered by Shopify, which enables us to provide the Services.
However, purchases made from our store are transactions directly between you and HOMEMART.
To the extent permitted by applicable law, Shopify is not responsible for products sold by HOMEMART or for the underlying transaction between you and HOMEMART.
Nothing in this section limits any rights or remedies that cannot legally be waived.
